Pretrial Diversion

Pretrial Diversion is a program sponsored by the Sullivan County Prosecutor’s Office which is designed to help people with little or no criminal history who have been arrested for a misdemeanor criminal offense. Successful participants in the Sullivan County Pretrial Diversion Program can avoid having a permanent criminal conviction on their record.

The specific requirements will vary by what a person is charged with, but can include things like community service, evaluation for substance abuse or anger control issues, random drug screening, paying restitution or obtaining a valid driver’s license.  Depending on the level of offense, all participants must pay the program fee which ranges from $334-$479 in addition to the costs mentioned above.

Eligibility is generally based on the type of offense committed and the person’s criminal history. It should also be noted that eligibility in this program is at the discretion of the prosecutor. It should be noted that DUI’s and Drug cases (including marijuana) are NOT eligible for Pretrial Diversion. Failure to successfully complete all the terms of your Pretrial Diversion Agreement could result in your misdemeanor charges being refiled against you.
